CUSTOM DESIGN TOS

These TOS are subject to change without warning. These TOS are final whether you read them or not, and proper action will be taken and proof provided to whoever may need it (such as PayPal) if you break them.

PAYMENT, FEES & REFUNDS
• Payment through PayPal ONLY, invoice ONLY. No refunds except in exceptional cases (detailed below).
• If you wish your custom adopt to be in a P2U base I do not own you must pay for the base plus the adopt's cost, upront and in full, as I must purchase the base myself, since they cannot be transferred to someone who did not buy them. You cannot forbid me from making other designs on the purchased base.
• In case I cannot purchase the base you wanted for whatever reason, you will be contacted with refund option and explanation.
• Cancelations and refunds are not possible once payment has been done (this applies for customs & pre-existing design purchases). If you attempt to cancel or refund a work this will be met with proper action.
• Invoices are due within 24 hours after sent, I will not reserve unpaid slots.
• The commercial rights for all my adopts are free, customers cannot charge others for them if the adopts are resold.
• I do not provide source files for adops.
• For customs, price will vary according to complexity. I will refuse any work I feel I cannot properly execute.
• Complexity fees can go up to 100% overcharge for extremelly complex designs and the minimum is 25%, please ask for a quote if you're not sure.
• For premade bases that are nude (human, humanoid, anthro) and require an outfit design there will be an extra charge of 25% minimum and up for this service also based on complexity.
• Only one complexity fee will apply at a time (Confused about this? ask).
• I do not accept art or characters as a form of payment.CONDUCT, COMMUNICATION AND BEHAVIOR
• Any form of poor manners, passive agression, rude behavior, unjustified demands, harrassment of any kind or overal nasty attitude will be met with a non refundable cancelation, you will also be blacklisted. I'll be respectful and kind to you and I expect the same from you.
• I do not provide direct means of contact such as Discord, Whatsapp, Telegram etc. Communication will be carried out through the platform you contact me at. This is due to past poor experiences and privacy concerns.
• Communication is priority to me and I will contact you when I make progress or a delay happens.
• I do not take private commissions. I will post my work as I see fit. Customer can request to remain anonymous.
• Minors under 18 may not request NSFW work. If I catch an underage person requesting NSFW work from me they will be blacklisted.WORKING HOURS AND WORKFLOW
• I work on a weekend basis only.
• I send WIPs every time I make progress, I will not continue working on the custom until I get a response, to either continue or change things. If I have a queue I'll move onto the next customer until the previous customer responds.
• There's a limit of 5 minor changes unless I got something wrong myself due to not understanding instructions/references, in that case I will correct as much as needed.DESIGNS & COMPLEXITY
• I will not draw anything such as tack on feral equine bases. But for humanoid/anthro bases that are nude I will draw outfits on them for an extra fee if requested (refer to the Payment, Fees & Refunds section for info).
• I don't work on text descriptions only, visual references are mandatory.
• Complex designs such as spotted/brindle/stripped horses will not be 100% accurate to the references, expect differences between the provided reference and the final product, even if minimal.
• If you want a design inspired by an existent design the final product may not look like a rip off of the original, and I will make enough changes to ensure that. Any responsibility for this type of work befalls on the customer and the customer acknowledges it at the moment of requesting the service.FILE DISTRIBUTION
• Finished or full res files of existing designs can be transferred via email, google drive and Toyhouse (where I upload all of my designs).
• If you have a Toyhouse account I will transfer the character directly to you over there. If you also want the files to be emailed to you please let me know.
• Do not remove mine or anyone else's credits from the finished product.
• Pre-existing designs are delivered within 24hs after payment cleared.MACHINE LEARNING
• Anyone found utilizing machine learning or derived technologies to create variations/alternative versions of my work, finishing my sketches or WIPS, creating alternative version of custom work or eisting designs, etc, without permission will be publicly blacklisted and exposed, and full legal action will be taken given the chance. The creator of any base that has been misused for machine learning purposes will be also contacted by me immediately and full details of the violating customer will be disclosed with them or any legal entity that requires them.

UNIVERSAL RULES

By purchasing an adopt (custom or pre-existing) you not only abide to the TOS but also to these rules. Failure to follow them will get you blacklisted.1- No radical changes in design/species.2- Don't use to promote hateful ideologies of any kind (problematic FICTITIOUS topics are allowed).3- Can change sex.4- Commercial rights are free and included with your purchase. Crediting me is not necessary but encouraged.5- Don't resell for a higher price unless value has been added to the character (art, crafts, etc). Purchased characters can be traded, gifted or resold for any currency and on any site.6- Any character acquired for free cannot be resold for any type of currency, only gifted or traded.

Premium equine design:
Includes:
• Tacked or untacked version (only one, also depends on the cosen base, some bases do not include tack).
• On a fully shaded P2U or F2U base of your choice.
• Color palette.Starts at 45USD.

Basic equine design:
Includes:
• Simple untacked design on a P2U or F2U unshaded base of your choice.
• Limited tail/mane options.
• Color palette.Starts at 22USD.(Special offer: Purchase 5 simple designs at once and pay 12USD for each, total: 60USD.)(Very complex designs will not be considered for the basic design option)

Human or anthro design:
Includes:
• Design on p2u or F2U base of your choice.
• NSFW option (if available).
• Outfit design (for an extra fee, if requested).
• Free hair design if the base does not have any hair options.
